Elderly Couple Hit in Valentine’s Day Crash, One Dead

Location: Southeast Division Street, Southeast Portland

A 78-year-old woman was killed on the spot when she was hit by a pickup as she was crossing Southeast Division Street with her husband on Valentine’s Day.

The woman and her 80-year-old husband were crossing at the corner, an unmarked crosswalk according to Oregon law, when they were hit by a 2014 GMC pickup truck driven by a 38-year-old. The husband sustained non life-threatening injuries.

The driver of the pickup stayed and cooperated with the police. They do not suspect drinks or drugs.

We extend our sympathies to the family and friends of the dead woman and hope her husband recovers completely and quickly.

In these cases the grief of losing a loved one is deepened by the knowledge that their death may have been due to someone else’s negligence. While it is a small consolation, it is possible to file a wrongful death claim under ORS 30.010-30.1000.

The Oregon statute outlines who is entitled to compensation. Spouses, children, and parents are the most common claimants, but under some circumstances, grandchildren, siblings, and grandparents may be able to bring a wrongful death claim as well. A Personal Representative, usually chosen by the family and approved by a judge, must bring the lawsuit for these beneficiaries.
