Because of the nature of their work, many workers are exposed to many dangers such as incomplete structures, electricity, power tools, hazardous chemicals, unguarded heights, heavy equipment, etc.

If they are injured while performing these dangerous tasks because of faulty or poorly designed machinery, an employer’s negligence, or another’s carelessness, they could be entitled to compensation through a workers’ compensation or personal injury claim.

A worker may be able to bring a personal injury claim IF a 3rd party (i.e. not their employer) is liable for the injuries. Otherwise, they should be able to receive compensation through workers’ compensation insurance. Some examples of 3rd party liability include.

  • Another driver causes an accident when the worker in driving for the job
  • A tool or piece of equipment is defective (manufacturer may be responsible)
  • Another person or company on the job site is negligent (like an outside contractor)

A competent Portland construction workers lawyer will be able to help you navigate through the claims process to get money for your medical bills, physical therapy, loss of wages, and other damages.
